These Terms and Conditions (“Terms”) govern your participation in coaching services provided by Nice Weather (“we,” “us,” or “our”). By signing up for or participating in any coaching session ("Services"), you agree to these Terms.
You must be at least 18 years old to participate in our coaching services.
Services are provided remotely or in person, as scheduled. Services are considered delivered once the scheduled time occurs, regardless of your attendance.
Payment for Services is due in full before services are rendered, unless otherwise agreed in writing. If we agree to a payment plan, you will be billed in equal monthly installments as stated in your engagement letter or invoice (e.g., $1,000 per month for three months). Prices and billing terms will be clearly stated in any engagement letter or invoice. We reserve the right to modify our rates with prior notice. If you purchased a package of Services, your total price for that package will not change during the agreed term.
If you purchase a package for Services, such as the Builders, Leaders, or Founders package, the first half (50%) of any package is non-refundable once Services commence, which is defined as submitting payment. Any remaining unused portion may be refunded at our discretion.
Services are a collaborative process, but results are not guaranteed. Your progress depends on your own effort, commitment, and context. We make no promises or warranties about specific outcomes.
Services are not to be considered therapy, medical treatment, legal advice, or financial consulting. You are responsible for your own decisions and actions. If you need professional help in those areas, you should consult a licensed provider.
To the fullest extent allowed by law, you agree to hold us harmless for any loss, injury, or damages arising from your participation in Services. This includes any actions you take (or don’t take) based on our conversations, materials, or advice. Services are offered in good faith, but we make no claims about fitness for a particular purpose.
We recognize that the unexpected happens. You may reschedule a Service with at least 24 hours’ notice. Canceled or missed without notice may be forfeited at our discretion. If we miss attendance for a Service, we will reschedule it at no cost or impact to you.
Materials we create or provide (e.g., worksheets, frameworks) remain our intellectual property. You may use them for personal, non-commercial purposes only.
We treat you and Services with discretion. However, confidentiality is not absolute. We may disclose information if required by law or if we believe someone is at risk of serious harm.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The parties agree that any claim, dispute, or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in San Bernardino County, California, and the parties hereby consent to the personal jurisdiction and venue of such courts.
We may update these Terms from time to time. If we make significant changes, we’ll notify you via email or our website.
